Terms and Conditions

Please read these terms carefully before registering for any courses with SCAL Academy.

Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

"SCAL Academy"
The Construction Safety School operated by Singapore Contractors Association Limited.
"Trainee"
Any individual registered to attend a course or programme.
"Course"
Any WSQ-accredited training programme, workshop, or certification offered by SCAL Academy.
"SSG"
SkillsFuture Singapore Agency, the government body overseeing skills funding.
"ECO"
Environment Control Officer certification under MOM regulations.
"SDU"
Safety Development Units required for ECO renewal.

Course Registration and Enrollment

2.1 Eligibility

  • Trainees must meet all prerequisites specified for each course, including age requirements, educational qualifications, and prior certifications.
  • Work-at-Height courses require trainees to be medically fit and at least 18 years of age.
  • SCDF certification courses require valid identification and may require company sponsorship documentation.

2.2 Registration Process

  • All registrations must be completed through our official website, corporate portal, or authorised training coordinators.
  • Registration is only confirmed upon receipt of full payment or valid funding approval.
  • Course placement is subject to availability and allocated on a first-come, first-served basis.

2.3 Personal Information

Trainees must provide accurate personal information matching their NRIC or FIN. Discrepancies may result in certification delays or invalidation. SCAL Academy collects and processes personal data in accordance with the Personal Data Protection Act (PDPA) of Singapore.

Payment and Refund Policies

3.1 Payment Terms

  • Full course fees must be paid before the course commencement date unless corporate credit terms have been pre-approved.
  • Accepted payment methods include credit/debit card, bank transfer, PayNow, and corporate cheque.
  • GST is applicable at the prevailing rate and included in all quoted fees.

3.2 Refund Policy

Refund eligibility depends on the timing of cancellation:

Note: Refunds for SSG-funded courses are subject to SkillsFuture Singapore's funding terms and may require additional processing time (up to 30 business days).

Cancellation and Rescheduling

4.1 Trainee-Initiated Changes

  • Requests to reschedule must be submitted in writing via email at least 7 calendar days before the course date.
  • Rescheduling is subject to seat availability in the requested alternative session.
  • Each trainee is permitted one free reschedule per registration. Subsequent rescheduling requests incur a $100 administrative fee.

4.2 Substitution Policy

If a registered trainee cannot attend, a substitute from the same company may attend instead, provided:

  • Written notification is received at least 3 business days before course commencement.
  • The substitute meets all course prerequisites and eligibility requirements.
  • No additional fee applies for substitution if prerequisites are met.

4.3 SCAL Academy Cancellations

SCAL Academy reserves the right to cancel or postpone courses due to insufficient enrollment, trainer unavailability, or unforeseen circumstances. In such cases:

  • Registered trainees will be notified at least 48 hours in advance where possible.
  • Trainees may choose a full refund or transfer to the next available session.
  • SCAL Academy is not liable for any consequential damages arising from course cancellation.

Funding Eligibility Disclaimers (SSG/SkillsFuture)

5.1 Funding Availability

  • SSG funding and SkillsFuture Credit claims are subject to approval by SkillsFuture Singapore and are not guaranteed.
  • Funding eligibility depends on trainee profile, company sponsorship status, and course-specific criteria.
  • Baseline and enhanced funding rates are determined by SSG and may change without prior notice.

5.2 Trainee Obligations

  • Trainees must achieve at least 75% attendance to qualify for SSG funding.
  • Absentee payroll claims require accurate documentation and are subject to SSG verification.
  • Trainees who do not meet attendance requirements must pay the full unfunded course fee.

Important: SCAL Academy facilitates funding applications but does not guarantee approval. Trainees are responsible for verifying their own funding eligibility through their SkillsFuture portal or employer.

5.3 Self-Sponsored Individuals

Self-sponsored trainees may use SkillsFuture Credit where applicable. Claims must be submitted through the MySkillsFuture portal before course commencement. SCAL Academy provides necessary documentation but cannot process claims on behalf of individuals.

Certification Requirements and Assessment Policies

6.1 Assessment Standards

  • All WSQ courses require trainees to pass both practical and theoretical assessments to receive certification.
  • Written assessments typically require a minimum score of 70% to pass.
  • Practical assessments are evaluated against competency standards set by the relevant authorities (WSH Council, SCDF, etc.).

6.2 Certification Issuance

  • Electronic certificates are issued within 10–15 business days of successful course completion.
  • Physical certificates may be requested at an additional charge of $30 per copy.
  • Certificates are issued in the name provided during registration. Name changes after issuance require legal documentation and incur administrative fees.

6.3 Re-Assessment

Trainees who do not pass assessments on the first attempt may be eligible for one complimentary re-assessment within 30 days, subject to course-specific policies. Subsequent re-assessments incur a fee of $150–$300 depending on the course.

6.4 Certificate Validity

Course certificates display validity periods where applicable (e.g., Work-at-Height, Confined Space). It is the trainee's responsibility to track expiration dates and arrange renewal training before expiry.

Code of Conduct for Trainees

7.1 General Conduct

  • Trainees must arrive punctually for all sessions. Late arrivals exceeding 15 minutes may be denied entry for that session.
  • Respectful behaviour toward trainers and fellow trainees is mandatory at all times.
  • Mobile phones must be silenced during training sessions unless required for course activities.

7.2 Safety Requirements

  • Trainees must comply with all safety instructions provided during training, particularly for practical sessions involving equipment or simulated hazards.
  • Appropriate Personal Protective Equipment (PPE) must be worn where specified.
  • Trainees under the influence of alcohol or drugs will be immediately removed from the course without refund.

7.3 Prohibited Conduct

The following actions may result in immediate dismissal from the course without refund:

  • Disruptive behaviour that interferes with other trainees' learning.
  • Cheating or attempting to cheat during assessments.
  • Unauthorized recording, photography, or distribution of course materials.
  • Harassment or discriminatory behaviour of any kind.

Intellectual Property Rights

8.1 Course Materials

All course materials, including but not limited to presentations, handbooks, assessment tools, videos, and digital content, are the intellectual property of SCAL Academy or our licensed partners. These materials are provided solely for the personal educational use of registered trainees during their enrolled course.

8.2 Restrictions

  • Course materials may not be reproduced, distributed, sold, or shared with third parties without written permission from SCAL Academy.
  • Trainees may not remove copyright notices or proprietary markings from any materials.
  • Digital access credentials (for e-learning components) are non-transferable and for individual use only.

8.3 Trademark

The SCAL Academy name, logo, and associated brand marks are registered trademarks. Unauthorized use is prohibited.

Limitation of Liability

9.1 Scope of Liability

To the fullest extent permitted by Singapore law, SCAL Academy's liability is limited as follows:

  • SCAL Academy's total liability for any claim arising from course participation shall not exceed the total course fees paid by the trainee.
  • SCAL Academy is not liable for indirect, consequential, or incidental damages, including but not limited to loss of profits, business interruption, or reputational harm.
  • SCAL Academy does not guarantee specific employment outcomes or salary increases following course completion.

9.2 Force Majeure

SCAL Academy is not liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, pandemics, government actions, or infrastructure failures.

9.3 Personal Property

SCAL Academy is not responsible for loss or damage to personal belongings brought to training premises. Trainees are advised to secure their valuables.

Governing Law and Dispute Resolution

10.1 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute arising from these terms or course participation shall be subject to the exclusive jurisdiction of the Singapore courts.

10.2 Dispute Resolution

  • Parties agree to attempt good-faith negotiation to resolve any disputes before initiating legal proceedings.
  • If negotiation fails, disputes may be referred to mediation through the Singapore Mediation Centre.
  • Nothing in this clause prevents either party from seeking urgent injunctive relief through the courts.

10.3 Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Amendments and Updates

SCAL Academy reserves the right to amend these Terms and Conditions at any time. Changes will be:

  • Posted on this page with an updated "Last Updated" date.
  • Effective immediately upon posting for new registrations.
  • Notified to registered trainees via email for material changes affecting existing bookings.

Continued use of our services following any changes constitutes acceptance of the revised terms.
